GENERAL CONDITIONS OF USE

  1. Information about the owner of the Site
    This site (www.voiceat.com), including its mobile version (hereinafter, collectively, the " Site ") is owned and managed by Voiceat Srls - Via S. Francesco d'Assisi 7, 73100 Lecce - P .IVA 05279090756 (LE) mail: amministrazione@voiceat.it (hereinafter, “ Voiceat ”)..

    2. Introduction
    The Site is an e-commerce platform aimed at the online purchase of products marketed by Voiceat to any user of the Site (hereinafter, the " User "). On certain occasions, for example connected to promotional initiatives, access to the Site may only be permitted to a limited audience.

Access and use of the Website by any User, regardless of the purposes of their visit, whether for consultation or purchase only, are governed by these General Conditions of Use (hereinafter, also referred to as " GCU "). .
By accessing and using the Site, the User agrees to be bound by these General Conditions of Use. If the User does not intend to accept the GCU, he/she must not use the Site.

Voiceat reserves the right to suspend or terminate a User's access to the Site at any time, without notice, in the event that Voiceat (a) reasonably believes that these GCU and/or the General Conditions of Sale and /or any other rules on the Site are violated or (b) you deem it necessary to do so for security reasons.

  1. Changes to the GCU
    Voiceat may periodically make changes to the TOU.
    The User acknowledges and accepts that, in case of use of the Site after the date on which the GTU were modified, such use will be considered as an implicit acceptance of the modified GTU.
    It is the User's responsibility to periodically check the TOU to verify whether changes have occurred.

    5. Accounts
    The User may decide to register their data through the Website and create a personal account (hereinafter, the " Account "). In the absence of an Account, the User will only be able to access or use some of the services or options offered on the Website. To create an Account you must provide:
    a) Name and surname;
    b) Date of birth;
    c) Telephone;
    d) Email address;
    e) Password required to access the Account.

  1. Accounts

The User may decide to register their data through the Website and create a personal account (hereinafter, the " Account "). In the absence of an Account, the User will only be able to access or use some of the services or options offered on the Website. To create an Account you must provide:
a) Name and surname;
b) Date of birth;
c) Telephone;
d) Email address;
e) Password required to access the Account.
The processing of such data will take place in accordance with the Privacy Policy (available at the link : https://www.voiceat.it/pages/privacy-policy ).

Responsibility for maintaining the confidentiality of your login information and controlling access to your Personal Account rests solely and entirely with the User. The User will be solely responsible for all activities carried out through their Account (including, by way of example, any purchase of products, even if made through their Account and/or any comments and/or reviews published on the Site , where there is the possibility for the User to publish comments and/or reviews).

You must immediately notify Voiceat of any breach of security or unauthorized use of your Account credentials of which you become aware.

Voiceat reserves the right to terminate and terminate a User's Account, at any time and without notice if Voiceat (a) believes, in its sole discretion, that the User is using his or her Account in violation of these GCU and/or the General Conditions of Sale and/or any other rules provided by the Site, (b) has reason to believe that a third party is using the Account of another User without the consent of the latter, or ( c) for security reasons or for maintenance reasons of the Site.

6. Intellectual property

6.1. Site and Protected Material
The User acknowledges and accepts that the Site contains confidential information protected by intellectual property laws. All intellectual property rights in the Site, including but not limited to software or HTML code, newsletters, texts, databases, drawings, photographs, images, designs, video and/or audio material and any other material contained in the Site (of hereinafter, the “ Protected Material ”), are the exclusive property of Voiceat and/or its licensors. All Protected Material is made available to the User by Voiceat and/or its licensors exclusively for personal and non-commercial use. By way of example and not exhaustively, the User will not be able to:
a) copy, reproduce, publish, transmit, distribute, perform, display, communicate, modify, create derivative works from, reverse engineer, sell, license or otherwise exploit the Site, or any portion of the Protected Material, including, by way of example only, include or create a link to the Site or any part of the Protected Material, without Voiceat's prior written authorization;
b) access or use the Site or any part of the Protected Material for commercial purposes or for any other purpose that competes with Voiceat and/or its licensors.

6.2. Brand names
The User acknowledges and accepts that Voiceat and/or the other companies of the group to which Voiceat belongs, and/or its licensors are the exclusive owners of the Voiceat trademark and logos, as well as any other trademark and/or logo appearing on the Site (hereinafter, the “ Brands ”). Any use of the Marks by the User is strictly prohibited and constitutes a violation of the intellectual property rights of Voiceat, the companies of the group to which Voiceat belongs and/or its licensors. Voiceat reserves the right to take action to obtain compensation for damages in the event of infringement of the Trademarks and/or in any case of violation of its intellectual property rights.

6.3. Hyperlinks
The Site may from time to time contain hyperlinks to other sites, web pages or third-party content. Voiceat does not control such sites, web pages and third party content and, therefore, cannot under any circumstances be held responsible for the accuracy, accuracy, correctness, security or reliability of any third party site, web page or content, nor will it in any way be responsible for the content, advertising, products, services or any other information or data located on or arising from such third party sites or webpages. Furthermore, Voiceat cannot be held responsible for any damage or loss suffered by the User resulting from their access, use or reliance on such sites, web pages or third party content.
The creation of links to the Voiceat Site, the framing of the Site and more generally any use of the Site's Protected Material or part of it, are subject to prior and express written authorization from Voiceat, which may be revoked at any time. moment at the sole discretion of the latter. Voiceat reserves the right to:
a) request the removal of any link to the Site that has not been, or is no longer, authorised;
b) request compensation for damages suffered as a result of the unauthorized connection.

7. Social Media
The User has the possibility to share on social networks (such as, for example, Facebook, Twitter, Pinterest, Google+, etc.) some information (product characteristics, images, news) present on the Site. This publication will be accompanied by a message prepared by Voiceat which can be customized by the User. For example, by clicking the "Like" or "Share on Facebook" icon, the content will be uploaded to the User's Facebook profile. The contents shared on social networks will be subject to the terms and conditions of use of each of the social networks which, therefore, must be previously consulted by the User. The User is exclusively responsible for the publication on social networks of the content originating from the Site and Voiceat cannot in any case be held responsible for the use of the same once the content has been published on the social networks. The User undertakes to indemnify and hold Voiceat harmless from any harmful consequences resulting from the publication by the User on social networks of any content originating from the Site and/or its combination with any other content.

8. General limitations on the use of the Site and User behavior
The User is required to use the Internet responsibly and with respect for the rights of other users of the Site and, in general, of other users of the Internet.
In particular, the User, by accessing the Site, will refrain from:
a) upload to the Site, publish, send by e-mail or transmit by any other means contents that are illicit, harmful, abusive, harassing, harmful, defamatory, vulgar, obscene, indecent, invasive of another's privacy, unpleasant, offensive or racially, ethnically or otherwise objectionable;
b) upload to the Site, publish, send by email or transmit by any other means any unsolicited or authorized advertising or promotional materials, false information, email chains and/or letters, or any other form of unauthorized commercial solicitation;
c) upload to the Site, publish, send by e-mail or transmit by any other means materials containing viruses or other codes, files or programs created to destroy, damage, interrupt or limit the functioning of any software and/or hardware or any networks electronic telecommunications;
d) interfere with, or disrupt the operation of, the Site or servers or networks connected to the Site, or violate the requirements, procedures, rules or regulations of networks connected to the Site;
e) damage or attempt to damage the enjoyment of the Site by any User, host or network, including without limitation, through the introduction of viruses into the Site, the deliberate overloading or saturation of the server and/or email boxes or, forging TCP/IP protocol information or any other header information included in any email message;
f) make or attempt to make any modifications or alterations to any part of the Site;
g) access data not intended for the User or log in to a server/account which the User is not authorized to access;
h) try to ascertain or test the vulnerability of a system or network or, again, try to violate security or authentication measures without having received authorization;
i) usurp the identity of another person;
j) carry out an activity or induce another person to carry out an illegal activity or any other activity that may infringe the rights of Voiceat, its suppliers, partners, distributors or its advertisers or any other User;
k) circumvent or attempt to circumvent, disable or otherwise interfere with any security features of the Site or features that (i) prohibit or restrict the use or copying of any Protected Materials or content and/or (ii) enforce limitations on use of the Site or the content accessible on the Site;
l) transmit or transfer (by any means) information or software derived from the Site to foreign countries and/or to foreign citizens in violation of any national or international law or regulation.
m) insert false and/or invented and/or imaginary data;
n) use the Trademarks improperly.
The User undertakes to comply with all national and international rules and procedures relating to online conduct and permitted content, including all laws in force relating to the transmission of technical data.
At any time and for any reason, Voiceat may, at its discretion, implement any system that allows the User to interrupt and terminate, without notice, the use of the Site or any service offered on the Site, in the event that the User has engaged in or Voiceat has the fear that he may engage in conduct in violation of these GCU and/or the General Conditions of Sale and/or any other rule present on the Site. Voiceat reserves the right to ask the User for compensation for damages in the event of non-compliance with these GCU and/or the General Conditions of Sale and/or any other rule on the Site.

9. Access and operation of the Site
The User is personally responsible for preparing the IT and telecommunications means that allow him to access the Voiceat Site. The connection costs and equipment necessary to access the Internet and use the Voiceat Site are entirely and exclusively the responsibility of the User.
The User acknowledges and accepts that use of the Site is at his sole risk. Voiceat cannot be held responsible for any damage that a User may suffer as a result of such use. Voiceat declines any responsibility for indirect damages, regardless of the causes, origins and nature of the same, deriving from the use and/or non-use of the Site, as well as from having given credence to any information directly or indirectly originating from the Site, including, by way of example and not limited to, costs deriving from the careless purchase of products and/or services offered on the Site, losses of profit, customers, data or other losses of intangible assets.

10. Responsibility
Voiceat does not provide guarantees of any kind, whether express or implicit, regarding in particular the integrity, accuracy, timeliness, non-violation of regulations, availability, reliability and completeness of the information on the Site, including information on the products, accessories or services offered on the Site and/or their suitability for a particular use that the User intends to make of them.
In the event that the User intends to make a complaint against Voiceat regarding the Protected Material of the Site and/or the products and/or services offered therein, such complaint must be made by sending a written communication to the following address: administrzione@ voiceat.it, no later than six months following the occurrence of the event giving rise to the complaint. The foregoing does not affect the rights of the User acting as a Customer pursuant to the General Conditions of Sale applicable to purchases made on the Website, recognized by the provisions of the Consumer Code (Legislative Decree 206/2005).

11. General clauses


11.1. Validity of the Contract
In the event that any provision of these GCU is declared invalid or ineffective due to a legislative change or following a ruling by a judicial authority, the remaining clauses of these GCU will remain fully valid and effective.


11.2. Applicable law and competent court
These General Conditions of Use are governed by Italian law.
Any dispute relating to the existence, interpretation and/or execution, termination of these General Conditions of Use will be referred to the jurisdiction of the Courts of the place where the User has his domicile or residence, if located in Italian territory.
The User also has the possibility to resolve any disputes, without resorting to Court, via the online dispute resolution platform available at the link http://ec.europa.eu/consumers/odr/.
