GENERAL CONDITIONS OF SALE (“GSC”)

1. Definitions


' Account ': the Account created by the Customer when registering on the Site.


' Online Coupons ': they are a credit, which could be issued by Voiceat Srls and can be used by the Customer or by a different beneficiary, for purchases solely on the Site. Online Coupons are valid for a maximum of one year from the date of issue.


' Gift Cards ': is a card, even virtual, which could be made available on the Site, issued by Voiceat Srls, prepaid by the Customer, with which the latter (or one of his beneficiaries) can purchase the Products on the Site, up to the amount of the Gift Card. Gift Cards are valid for a maximum of one year from the date of issue.


' CGV ': these general conditions of sale.


' General Conditions of Use ': these are the general conditions of use of the Site present at the following link: https://www.voiceat.it/pages/conditioni-generali-duso .


' Customer ': any natural and/or legal person who purchases the Products through the Site.


' Consumer Code ': Legislative Decree 6 September 2005, n. 206 and subsequent amendments and additions.


' Order Confirmation Email ': has the meaning indicated in the art. 5 of these GCS.


' Shipping Address ': the address indicated by the Customer on the Order for delivery of the Products.

' Privacy Policy ': the document present at the following link: https://www.voiceat.it/pages/privacy-policy

' Order ': the purchase order relating to the Products placed by the Customer on the Site.


' Party ' or ' Parties ': Voiceat Srls and/or the Customer.


' Product ': any product offered for sale by Voiceat Srls through the Site.


' Voiceat Srls ' or ' Seller ': the Italian company Voiceat SrlsSrl, with registered office in Milan, via Timavo, 34, 20124, tax code and VAT number 09551070965 - REA Milan 2098389.


' Customer Service ': the Voiceat Srls customer service can be contacted at the contact details indicated in the following art. 4.


' Site ': the website: www.Voiceat Srls.it also in mobile version and the related app (where available).


' Terms and Conditions ': the GCS, the General Conditions of Use, the Privacy Policy and any other rules and/or documents present on the Site.


' Territory ': Italy (excluding Campione d'Italia and Livigno).

2. Object
The purpose of these GCS is to inform each potential Customer of the conditions and methods with which Voiceat Srls carries out the sale and delivery of the Products and to define the contractual rights and obligations of the Parties in relation to the sale of the Products and provision of any services offered on the Site by Voiceat Srls. The GCS apply, without limitation or condition, to all sales of the Products and services offered by Voiceat Srls on the Site.
Sending an Order by the Customer entails total and unconditional acceptance of these GCS, as well as all the Terms and Conditions of the Site.
Voiceat Srls reserves the right to modify the GCS at any time and even without notice. It remains the Customer's responsibility to periodically check the GSC to verify whether changes have occurred. In any case, it is understood that the GCS applicable to the Order are always those accepted by the Customer at the time of sending the Order.
The GCS constitute an integral part of the Terms and Conditions of the Site.
The Customer declares to have full capacity to act and enter into a contract for the purchase of the Products and/or services on the Site based on these GSC. Voiceat Srls cannot in any case be required to verify the capacity to act of the visitors and customers of the Site. In the event that a Customer who does not have the necessary capacity to act (for example a minor) places an Order, without prejudice to the responsibility of the their parents or legal guardians for this Order and the related payment, Voiceat Srls may refuse to accept and/or follow up on the Order.
The Customer declares and guarantees that the purchase of Products on the Site is intended for strictly personal use, with the exclusion of any commercial activity and/or in any case for other uses.
These GCS must be carefully examined by the Customer before completing the purchase procedure of the Products and/or services through the Site. These GCS can be printed and kept by any person who has visited the Site.

4. Product Characteristics
The Customer can select one or more Products from the different categories available on the Site.
Voiceat Srls may change the assortment of Products offered for sale on its Site and/or the information relating to them such as prices, description or availability at any time, without any obligation to give notice.
Before sending the Order, the Customer can view on the Site all the information referred to in article 49 of the Consumer Code such as, by way of example but not limited to, information relating to the Seller, the price, including taxes and shipping costs, the essential characteristics of the Products or services you wish to purchase and together with all other mandatory information required by Italian law.
The Products comply with the legislation applicable in Italy in force at the time of the Order. The Products purchased by the Customer can only be delivered within the Territory. Voiceat Srls cannot be held responsible for the non-compliance of the Products with the legislation of the different country in which the Customer wishes to use the Products.

5. Availability of Products
The offers presented by Voiceat Srls are valid for as long as they are published on the Site and within the limits of available stocks. For Products not immediately available in Voiceat Srls warehouses, the offers published on the Site will be valid subject to availability. Information on the availability of the Products will be provided to the Customer when an email confirming receipt of the Order is sent (hereinafter, the “Order Confirmation Email”).
Even after sending the Order Confirmation Email, there may be cases of partial or total unavailability of the Products. In this eventuality, the Customer will be promptly informed via e-mail of the unavailability of the Product and of the total or partial cancellation of the Order and will be able to decide:
• whether to accept delivery of only the available Products, obtaining a refund for the unavailable ones, or
• whether to request cancellation of the Order, with consequent reimbursement of any amounts already paid, by communicating this via e-mail to the following address: amministrazione@Voiceat Srls.it.

6. Ordering of Products
Each Order sent by the Customer entails, in addition to the acceptance of these GCS, also the acceptance of the Privacy Policy and, in general, of the Terms and Conditions and constitutes an offer to purchase the Products indicated in the Order.
All Orders are subject to acceptance by Voiceat Srls which reserves the right, at its sole discretion, to refuse the Order without giving reasons, including cases in which:
• the Orders cannot be executed due to an error in the information and data provided by the Customer at the time of placing the Order, by way of example and not exhaustively: the payment card number, expiry date or the number of the security code of the card used for payment is incorrect; incorrect billing address (for example, if the billing address indicated does not match the information held by the bank that issued the payment card); insufficient or incorrect shipping address (for example, incorrect address, city, country or postal code); or if misleading information is provided by the Customer;
• an error relating to the Products ordered has occurred on the Site (by way of example and not limited to, an error relating to the price or description of the Products as shown on the Site);
• the Products ordered are no longer available on the Site and/or in stock.
Voiceat Srls also reserves the right to suspend or cancel the processing of an Order and/or delivery, regardless of the nature and progress of the processing, in the event of non-payment or partial payment of any sum due by the Customer , in case of problems with payment, or in case of fraud or attempted fraud relating to the use of the Site, also with reference to previous Orders.
In case of refusal of the Order, Voiceat Srls will communicate to the Customer, within 30 working days of placing the Order, the impossibility of accepting the Order. The Customer will be able to check the details of their Order and correct any errors before confirming/sending the Order.
Once the Customer has confirmed the Order, the Customer declares to have knowingly accepted the content and conditions of the Order in question and, in particular, these GCS and the Terms and Conditions, prices, volumes, characteristics, the quantities and delivery times of the Products offered for sale and ordered by the Customer.
After submitting the Order, the Customer will not be able to cancel it, however it is advisable to contact Customer Service for any resolution of problems relating to the Order. The Customer however has the possibility to take advantage of the right of withdrawal, as provided for in the following art. 11.
The sale will be final only upon acceptance of the Order by Voiceat Srls, by sending the Order Confirmation Email to the Customer.
A second e-mail will be sent to the Customer when the Products included in the Order are shipped.
Voiceat Srls will have the right to collect the full price of the Order from the moment the Order Confirmation Email is sent.
Voiceat Srls recommends that the Customer keep the emails received from Voiceat Srls on paper or electronic media. By processing the Order, the Customer accepts that the aforementioned emails will be sent to the email address entered by the Customer upon purchase and/or registration of their Account. Voiceat Srls will not be responsible in the event of entering an invalid email address and/or failure to receive the Order Confirmation Email for reasons not directly attributable to Voiceat Srls. In this case, the sale will be considered final. The Customer may, however, exercise the right of withdrawal under the conditions set out in article 11 of these GCS.
Once the Order Confirmation Email has been received, the orders will be processed by Voiceat Srls. Orders received on Saturdays and Sundays and on public holidays are not processed on the day the Order is received.

7. Product Prices
The prices of the Products offered for sale on the Site are indicated in Euros. Voiceat Srls may change the sales prices of the Products at any time and without notice and without the need for justification or specification. This change will be notified to the Customer before sending any Order.
The prices of the Products include VAT applicable at the time the Order is sent. Any change in the applicable VAT rate will automatically be reflected in the price of the Products sold by Voiceat Srls through the Site.
The prices of the Products do not include shipping costs which, as they cannot be calculated in advance, will be displayed in the Order summary before the Customer requests confirmation of the Order. Shipping costs can be modified at any time by Voiceat Srls, but the modifications will not be applied to Orders already sent and accepted by Voiceat Srls. Voiceat Srls invites the Customer to regularly consult the GSC.

  1. Payment
    The Customer guarantees Voiceat Srls that he has the necessary authorizations to use the payment method chosen for his Order at the time of sending the Order. All Orders are payable in Euros, taxes and mandatory contributions included. Any bank charges will be borne exclusively by the Customer, even in the event of a refund.
    In the event of failure or delayed payment of the Order by the Customer, Voiceat Srls reserves the right to apply default interest equal to the legal interest rate starting from the tenth working day following the date of the Order or from the notification of the rejection of the bank payment.
    The payment methods are as follows:
    • Credit cards:, debit, prepaid: the credit cards accepted on the Site are the following: Visa, MasterCard. Credit card payments are handled through the Stripe payment gateway;
    • Shop Pay
    • Online Coupons , where available;
    • Gift Cards , where available.

    Voiceat Srls reserves, in any case, the right to suspend or cancel, at its discretion and at any time, the execution of an Order and/or the shipment of the Products ordered in the event of non-payment or partial payment of any sum to charged to the Customer, in the event of late payment or in the event of fraud or attempted fraud through the use of the Voiceat Srls Site, also in relation to previous Orders.
    Voiceat Srls also reserves the right to request a photocopy of the Customer's identity card for each payment made by credit card, as well as any other information relating to the Customer's identity necessary for identification in order to guarantee security and correctness of transactions carried out through the Site.
    As part of the fight against Internet fraud, information regarding the Customer's Order may be transmitted to third parties authorized by law or designated by Voiceat Srls for the sole purpose of verifying the Customer's identity, the validity of the Order, the payment method used and place of delivery.

    9. Delivery of the Products
    The Products ordered by the Customer based on these GCS will be delivered to the address indicated by the Customer as the Shipping Address in the Order.
    Voiceat Srls ships exclusively within the Territory, using the shipping services of Poste Italiane.
    A manager of the Poste Italiane company will make the delivery to the Shipping Address and ask you to sign an electronic receipt. This receipt will constitute proof of delivery by the carrier and receipt by the Customer, or the recipient of the Order, of the Products.
    Deliveries are made on working days (Monday to Friday). No deliveries are made on Italian public holidays.
    In case of absence, the Customer, or the recipient of the ordered Products, will receive a notice of attempted delivery, with which they can contact the carrier at the address indicated on the notice in order to organize a new delivery.
    If you are not contacted, the carrier will make a further step in the following days. In the event that after two delivery attempts it has not been possible to deliver the package, the Customer or the recipient of the Order will receive a notice communicating the address of the Postal Center where the package will be kept for ten working days. The Customer or the recipient of the Order will be able to collect the package at this center. Upon expiry of this deadline, the package will be returned to Voiceat Srls and the Customer will be reimbursed, in the manner chosen at the discretion of Voiceat Srls, the amount of his Order minus shipping costs, any storage costs and any other additional costs generated by the prolonged unavailability of the Customer.
    It is not possible to raise any disputes relating to the shipment itself if the package appears to have been delivered. For this purpose, the carrier's IT system is authoritative.
    For shipments to Calabria, Sicily and Sardinia, delivery times may be extended by 1 or 2 working days.
    Delivery times are indicative and start from the moment the email confirming shipment of the Products to the Customer is sent.
    Once prepared and shipped, the Order will be assigned a package number which will allow the Customer to find out about the status of the shipment and delivery of the Products.
    No responsibility can be attributed to Voiceat Srls in the event of a delay in processing the Order or delivering the Products.
    No delivery deadline is binding for Voiceat Srls or Poste Italiane, with the consequence that the latter will in no case be responsible for any damage caused to the Customer and/or to the recipient of the Products from the delay in delivery.

    10. Defects, non-conformity and damage to the Products


10.1 Defects and damage to the external packaging upon delivery
Upon delivery of the Products by the courier, the Customer is obliged to check that the packaging is intact, not damaged, wet or otherwise altered, including the closing materials (adhesive tape or strap). Any damages must be, under penalty of forfeiture:
• immediately reported to the courier making the delivery. Once the courier's document has been signed without reservations, the Customer will not be able to make any objection regarding the external characteristics of what was delivered; and then
• communicated no later than the following 2 (two) days, via e-mail to Customer Service at the following address: amministrazione@Voiceat Srls.it
Failure to comply with the correct procedure excludes any appeal against the courier, including the right to reimbursement of the Order and/or redelivery of the ordered Products.


10.2 Defects, non-conformity and damage to the Products
In the event of a lack of conformity of a Product pursuant to article 129 of the Consumer Code, the legal guarantee referred to in articles 130 and 132 of the Consumer Code will apply. The Customer has the right to restore, without charge, the conformity of the goods through repair or replacement. In the event that these remedies fail, the Customer has the right to an appropriate reduction in the price or termination of the contract. The Customer loses these rights if he does not report the lack of conformity to Voiceat Srls within two months from the date on which he discovered the defect. Voiceat Srls is responsible when the lack of conformity occurs within two years of delivery of the Product. The action aimed at asserting defects not maliciously concealed by Voiceat Srls expires, in any case, within twenty-six months from delivery of the Product.
The Customer of the Order must contact Customer Service reporting the lack, defect, damage or non-conformity of the Products to find out how to return the damaged, non-compliant and/or defective Product or Products. The Customer must follow the procedure for returning damaged, non-compliant and/or defective Products which will be indicated by Customer Service; otherwise, the Customer will not be able to claim any refund or replacement of the Products in question. To be replaced, the Product, even if defective, must also, when returned to Voiceat Srls, be complete with the original packaging and all the accessories and documentation received by the Customer at the time of delivery. Returning the Product without the original packaging, accessories and documentation referred to above prevents Voiceat Srls from replacing the Product itself at the manufacturer and makes the replacement impossible.
Customer Service may request information relating to the Customer's identity and carry out any verification that may be useful.


10.3 Replacement of Products
In the event of a dispute pursuant to the previous paragraphs 10.1 and 10.2, Customer Service may carry out any checks deemed useful for processing the matter.
Once the Products returned by the Customer have been received, Voiceat Srls will verify the validity of the Customer's complaints. Where this verification is positive, in compliance with the provisions of article 130 and following of the Consumer Code, Voiceat Srls will replace the defective, damaged or non-compliant Product and will send it to the Customer as soon as possible and in any case within 30 (thirty ) working days from receipt of the Products. Shipping costs will be paid entirely by Voiceat Srls. In the event that Voiceat Srls is unable to proceed with the replacement of the Products within the aforementioned deadline, Voiceat Srls will immediately notify the Customer at the email address indicated at the time of purchasing the Products and/or registering the Account and will propose the following alternatives to the Customer:
• reimbursement of the cost of such Products and shipping costs (in the event that the Customer provides proof of the cost incurred to return the Products); if the Customer decides to adhere to this alternative, the refund of the price will be made by Voiceat Srls by re-crediting the relevant sum through the payment method used for the payment as soon as possible, and in any case within 30 (thirty) working days from the date on which you receive the Products;
• recognition of a credit (equal to the cost of such Products and shipping costs where the Customer provides proof of the cost incurred to return the Products), with the provision of an Online Voucher to be spent on purchases on the Site.
In the event that, after having examined the returned Products, Voiceat Srls deems that the complaints are unfounded, the Customer will not be entitled to a refund and the Products will be returned at the Customer's expense.

11. Withdrawal


11.1 Right and Terms for the Exercise of Withdrawal
In compliance with the provisions of article 52 of the Consumer Code and without prejudice to the exclusions referred to in article 59 of the same Consumer Code (in particular the hypothesis of purchase of clearly personalized goods or the supply of sealed goods which are not lend themselves to being returned for hygienic reasons, such as for example cosmetics, or related to health protection that have been opened after delivery), the Customer may, within the period of 14 (fourteen) days from acquiring physical possession of the package containing the Products ordered or, in the case of purchase of multiple goods ordered by the Customer in a single Order and delivered separately, from the acquisition of physical possession of the last Product purchased, withdraw from the purchase contract without penalty and without any reason.
In the case of purchase of a service, the right of withdrawal may be exercised by the Customer within 14 (fourteen) days from the date of receipt of the Order Confirmation Email, provided that the provision of this service does not has yet been completed. Any Gift Card, where available, must be understood as a service pursuant to this clause.
To respect the withdrawal deadline, it is sufficient for the Customer to send the communication relating to the exercise of the right of withdrawal before the withdrawal period expires.


11.2 Methods of exercising the right of withdrawal
To exercise the right of withdrawal, the Customer is required to inform Voiceat Srls of his decision to withdraw from the contract by registered mail sent to the address: Via S. Francesco d'Assisi 7, 73100 Lecce (LE) of his decision to withdraw from contract. To this end, you can use the standard withdrawal form provided for in Annex I part B of the Consumer Code, with the following content:
- Recipient: Voiceat SrlsSrl, Via S. Francesco d'Assisi 7, 73100 Lecce (LE):
Hereby, the undersigned __________ notifies the withdrawal from the purchase contract of the following goods: [insert a description of the products purchased, MANDATORY indicating the order number], ordered on _________ (or received on __________) and requests a refund of the amount paid for the returned products, by crediting the relevant sum via the payment method used;
- Name, Surname, Address of the Customer
- Client's signature (only if the form is notified in paper version)
- Date


11.3 Consequences of exercising the right of withdrawal
Once the right of withdrawal has been exercised pursuant to this article, within the terms and according to the methods described below for the return of the Products, the Customer will be able to obtain at his/her choice, as requested at the time of sending the withdrawal notice:
• reimbursement of the amount paid for the returned Products, by re-crediting the relevant sum via the payment method used;
• a credit of an amount equal to the price of the Products returned in the form of an Online Voucher, usable only on the Site.
In the event that the Order was paid with a Gift Card, the refund will be paid via Online Voucher.
The refund of the price of the Product (or the provision of the Online Voucher, if chosen by the Customer) will take place within 14 days of receipt of the Customer's notice of withdrawal. Voiceat Srls may withhold the refund or wait to issue the Online Voucher until it has received the return of the Products included in the Order or until the Customer has demonstrated that he has sent the Products back, depending on which situation occurs first .


11.4 Costs and methods of returning the Products
Products must be returned in their original packaging and must arrive “as new” without any damage to the Product or Product packaging.
In compliance with the provisions of article 57, paragraph 1, of the Italian Consumer Code, the return costs will be borne exclusively by the Customer. Packages sent at the recipient's expense will not be accepted.
In case of exercising the right of withdrawal, the Customer returns the goods to Voiceat Srls, without undue delay and in any case within 14 (fourteen days) from the date on which he communicated to Voiceat Srls his decision to withdraw from the contract.


Without prejudice to the impossibility of exercising the right of withdrawal in the cases provided for by the art. 59 of the Consumer Code (including the case of purchase of sealed goods that are not suitable for return for hygienic reasons if they have been opened after delivery), the Customer is still responsible - even if he abstains from removing the seals of the Product and/or its packaging - the decrease in the value of the Product and/or its packaging, resulting from handling the Product and/or its packaging other than that necessary to establish the nature, characteristics and the functioning of the assets.
If the right of withdrawal is exercised, Voiceat Srls will not be responsible for the transport costs for the return or for any loss or damage to the Products attributable to third parties.


The Products must be returned to Voiceat Srls in their substantial integrity, with their original packaging, accessories, instructions for use and anything else supplied with them, by post to the following address:

Voiceat Srls only accepts correctly addressed parcels or registered letters.
Any risk connected to the return of the Products will be borne exclusively by the Customer and/or the recipient of the Order itself, unless the Customer / recipient of the Order does not demonstrate that he has deposited the Products to be returned with a carrier.

12. Duration
These GCS, as amended from time to time, will apply for as long as the Products are offered for sale on the Site and until the terms of the guarantees expire.
In any case, the art. 13 (Liability) will survive the termination of these GCS.

13. Responsibility
Voiceat Srls assumes no responsibility for disservices attributable to the courier, to the act of a third party, to the Customer's fault or attributable to force majeure or unforeseeable circumstances or any other event that is not under the exclusive control of Voiceat Srls, even if employees from malfunctions and disservices of the Internet network, in the event that it is unable to execute the Order within the times established by these GSC.
Voiceat Srls will also not be responsible for damages, losses and costs suffered by the Customer following the failure to execute the Order for reasons not attributable to Voiceat Srls, and unless they depend on acts or omissions of Voiceat Srls, having, in the latter case, the Customer is only entitled to a full refund of the price paid and the shipping costs incurred.
Voiceat Srls cannot be held responsible for the information, data and any technical or other inaccuracies that may be contained in the Site, if they have been communicated by third parties and have been verified by Voiceat Srls according to the criteria of ordinary diligence. In particular, the information and contents available on the Site are provided «AS IS» (in the state in which they are found) and Voiceat Srls does not provide guarantees of any kind, whether express or implicit, in relation to the integrity, accuracy, timeliness , non-infringement of third party rights, availability, reliability or completeness of the information and content, including but not limited to, information on the Products, accessories or services appearing on the Site and/or their suitability for a specific use. Voiceat Srls will not be in any way responsible for the improper use of the Products and/or services by the Customer and/or recipient of the Order, and in particular for the case of failure to comply with the instructions for use of the Products. Voiceat Srls will not be in any way responsible for any damage caused to the Customer or third parties resulting from said non-compliant use.
Voiceat Srls assumes no responsibility for any fraudulent or illicit use that may be made by third parties of credit cards, checks and other means of payment, upon payment of the purchased Products, if it demonstrates that it has adopted all possible precautions based on the best technology and experience of the moment and on the basis of ordinary diligence.
Voiceat Srls declines all responsibility for direct and indirect damages, whether foreseeable or not, consequent and/or connected to the use of the Site by the Customer. If Voiceat Srls is held responsible for damage suffered by the Customer and attributable exclusively to the transmission of an Order, such liability will be limited to the amount of the Order actually paid by the Customer to Voiceat Srls.
Nothing in these GCV excludes or limits the liability of Voiceat Srls towards the Customer and/or recipient of the Order for fraud, death or personal injury caused by the negligence of Voiceat Srls, violation of the applicable provisions of the Italian Consumer Code or by any other liability that cannot be excluded or limited by law. Any complaint presented by users of the Site, including all Customers, against Voiceat Srls must be presented, under penalty of forfeiture, within 6 (six) months following the occurrence of the event which is the subject of the complaint.
Voiceat Srls and/or its commercial partners will not be in any way responsible for the improper use and/or disclosure to third parties of the Customer's registration/access information.
Voiceat Srls believes in the quality of the products marketed, however the Customer, before application, is required to ensure that he is not allergic to any of the ingredients of the Products. Voiceat Srls will not be responsible for any reactions to the ingredients of the Products sold.

14. Images
Voiceat Srls undertakes to ensure that the colors of the images displayed on the screen by the Customer are as similar as possible to the actual colors of the Product. In any case, Voiceat Srls cannot under any circumstances guarantee an exact and precise color match as the colors of the images and photographs may vary due to multiple factors and variables including screen and resolution settings.

15. Customer Obligations
The Customer undertakes to pay the price of the Product(s) purchased in the times and ways indicated in these GSC.
The Customer undertakes, once the online purchase procedure has been completed, to print and keep these GCS.
The Customer is solely responsible for the correctness of the data entered in the registration procedure and undertakes not to enter false and/or invented and/or imaginary data. The Customer holds Voiceat Srls harmless from any liability deriving from the issuing of incorrect tax documents due to inaccurate data provided by the Customer.
The use of the Customer's registration/access username and/or password constitutes proof of the Customer's identity for the purpose of exercising the right of Voiceat Srls, after sending the Order Confirmation Email, to demand the related amounts. The provision of the credit card number and the final validation of the Order constitute proof of acceptance of the Order and make the sums indicated for the purchase of the Products indicated in the Order payable. The computer records of Voiceat Srls and Voiceat Srls' partners will constitute proof of communications, Orders, deliveries and payments between the Parties.
The protection of its Customers' personal information and the provision of a high level of security are priorities for Voiceat Srls, but the Customer is also required to protect their personal data. In particular, the Customer must maintain the security of their online transactions, for example by refraining from communicating their username and/or password to others and by changing said password regularly.

16. Retention of title
Ownership of the Products ordered will remain with Voiceat Srls until the entire consideration for the Order, including shipping costs, taxes and other mandatory contributions (where applicable) are paid in full by the Customer.

17. Intellectual Property
All figurative and non-figurative trademarks present on the Products, on the Site, including the "Voiceat Srls" trademark, images, illustrations and logos and any content present on the Site (including, without limitation, the Terms and Conditions and these GCS) are the exclusive property of Voiceat Srls and/or the respective owners of the intellectual property rights thereon.
The reproduction in whole or in part, modification or use of such trademarks, illustrations, images and logos, or any other content of the Site, for any reason and by any means, without the express written authorization of Voiceat Srls and /or the respective owners of the intellectual property rights therein is strictly prohibited.

18. Personal Data
Voiceat Srls collects and processes the personal data of the Customer and, if applicable, that of the recipient of the Order in order to provide its Products and services in accordance with these GCS. 20. General Clauses


20.1 Partial disability
If one or more provisions of these GCS are declared invalid or ineffective due to a legislative change or following a ruling by a competent judicial authority, the other provisions of these GCS will remain fully valid and effective.


20.2 Waiver
The fact that one of the Parties does not assert against the other a violation of any of the obligations contained in these GCS will not be understood as a waiver of obtaining the fulfillment of the obligation in question for the future.


20.3 Applicable law and competent jurisdiction
These GCS and all sales of Products and services on the Site are governed by Italian law. Any dispute relating to the validity, interpretation, execution or termination of these GCS will be referred, in the absence of a settlement, to the jurisdiction of the competent Italian courts based on the place of residence or domicile of the Customer, if located in Italy.
The Customer also has the possibility to resolve any disputes relating to purchases of the Products, without resorting to Court, via the online dispute resolution platform available at the link http://ec.europa.eu/consumers/odr/.
